The Department of Labor (DOL) has announced the suspension of enforcement for the 2024 farmworker rule, effective June 20, 2025. This decision aims to provide clarity for American farmers involved in the H-2A program amidst ongoing legal challenges.

Federal court injunctions have led to significant legal uncertainty and operational challenges. The DOL clarified that it will not enforce the 2024 final rule immediately, offering predictability for agricultural employers as litigation continues and further regulatory actions are considered.

The implementation of the rule had already been halted due to federal injunctions. This new guidance does not alter existing regulations or limit the Wage and Hour Division’s authority to enforce H-2A requirements established before the 2024 final rule. It supersedes any conflicting guidance but does not create legally enforceable obligations or change statutory or regulatory requirements, ensuring full enforcement of U.S. immigration laws.
