Attorney General James Uthmeier announced that the Office of Statewide Prosecution, in cooperation with the Office of the State Attorney for the Thirteenth Judicial Circuit, will file charges against Leonardo Gomez Hernandez, a Mexican national accused of entering the United States illegally. The charges stem from an incident on October 20, 2025, during a traffic stop in Hillsborough County.
According to authorities, a Florida Highway Patrol Trooper stopped a vehicle on State Road 579 due to an improperly displayed tag. During the stop, it was determined that both the driver and passenger had entered the country without legal documentation. When attempting to detain Gomez Hernandez under the federal-state 287(g) program, he allegedly resisted arrest and tried to flee. The trooper deployed his taser as Gomez Hernandez reportedly choked and punched him.
Gomez Hernandez was detained after backup arrived at the scene. He faces charges of Resisting an Officer with Violence and Battery on a Law Enforcement Officer. Both are second-degree felonies and carry penalties of up to 15 years in prison and a $10,000 fine each. He is currently being held without bond at Hillsborough County Jail.
Attorney General Uthmeier stated: “Florida will not tolerate violent criminals—especially those who shouldn’t even be in our country—attacking our law enforcement officers. Our troopers risk their lives to keep this state safe, and those who think they can assault a Florida officer will face the full weight of the law.”
