Attorney General James Uthmeier has initiated a legal investigation into RAD Diversified REIT, Inc., its subsidiaries, and owners Brandon “Dutch” Mendenhall and Amy Vaughn. The investigation stems from allegations that the company and its owners may have breached Florida’s Deceptive and Unfair Trade Practices Act or other laws.
Uthmeier stated, “Our office has received complaints that a popular internet duo selling real estate investment services through their fund is pocketing cash instead of buying properties as advertised.” He further noted concerns about the operation being a Ponzi scheme, emphasizing the need to protect Floridians from potential fraud.
Mendenhall and Vaughn are known for promoting their fund online and through social media, encouraging investments in real estate via RAD Diversified REIT. They also conduct seminars to attract investors who might not have sufficient funds to purchase property independently. However, several investors have reported difficulties in obtaining returns or refunds due to alleged obstructions by Mendenhall and Vaughn.
The subpoenas aim to gather information on these complaints and verify whether the company holds real estate assets matching the value invested by customers. The requested documents include communications with customers, marketing materials, financial records, and other relevant documentation. The deadline for submitting these documents is set for July 18, 2025.
Special Counsel Ellen Lyons and Senior Assistant Attorney General Miles Vaughn are overseeing the case.
