Today, the Foundation for Government Accountability (FGA) commended Representative Harriet Hageman from Wyoming for her introduction of the Seventh Amendment Restoration Act. This proposed legislation aims to protect Americans' right to a fair trial.
The act is a response to the Supreme Court case SEC v. Jarkesy, where it was determined that the Securities and Exchange Commission (SEC) violated the defendant's right to a jury trial by utilizing its own judges in many cases. The agency's high success rate before these appointed judges has raised concerns about fairness and impartiality.
Stewart Whitson, Senior Director of Federal Affairs for FGA, stated, "Rep. Hageman’s Seventh Amendment Restoration Act would throw a lifeline to Americans stuck in the swamp of the agency court system. Her legislation represents a critical return to proper separation of powers by restoring the Article III branch’s constitutional role and helping individuals reclaim their right to fair proceedings in an impartial court."
