Supreme Court ruling ends Chevron deference; FGA celebrates shift in judicial interpretation

The Foundation for Government Accountability (FGA) is celebrating the Supreme Court of the United States' decision in the case Loper Bright Enterprises, et. al. v. Raimondo, which ends Chevron deference. This legal doctrine generally required federal courts to defer to an agency’s interpretation of an ambiguous statute as long as the interpretation was reasonable.

FGA's amicus brief in the Loper case argued that courts should be responsible for interpreting ambiguous statutes, not federal agencies. The Court’s landmark decision validates FGA’s argument and restores constitutional order by ending Chevron deference.

“For nearly 40 years, unelected bureaucrats have used Chevron to expand their power and diminish opportunities to achieve the American Dream. Today, that ends,” said Stewart Whitson, Senior Director of Federal Affairs for FGA. “This starts a new era in Washington, slowing the accelerated growth of the administrative state and paving the way to a return to constitutional order.”

The decision rebalances proper separation of powers while promoting consistency and predictability in applying law. It aims to simplify litigation, reduce costs, and return responsibility for interpreting statutes to the judiciary.

“This decision will help level the playing field for individuals, workers, and small businesses as Congress works to define a more limited scope of power granted to agencies,” said Whitson. “While this decision is a huge win for the American people, it won’t solve all problems associated with the administrative state. Now, Congress must respond and reclaim its legislative power from agencies as the Supreme Court has reclaimed its judicial power.”

“Not only will this decision restore constitutional order, but it will jump-start America’s economy, dramatically reduce red tape, and maximize individual liberty,” added Whitson.

FGA has created a website with recommendations for post-Chevron legislative actions aimed at reinvigorating the economy and reviving the American Dream.
